What is private law?

For many centuries, legal theory has divided law into two great branches: public law and private law. According to the well-known definition by the Roman jurist Ulpian, ‘publicum ius est quod ad statum rei Romanae spectat, privatum quod ad singulorum utilitatem…’ [public law is that which concerns the affairs of the state, and private law is what concerns the interests of individuals]. (Digesta 1.1.1.2).

Private law regulates civil and commercial matters, such as companies, property (chattels, immovables, and intangible rights), contractual and non-contractual obligations, family relations, and successions (testamentary and statutory).

Attorney Dr. Matthew Pilich is an experienced specialist in this field. He worked at the Supreme Court for more than a dozen years, starting as an assistant judge in the Civil Chamber and ending as a member of the Office of Studies and Analyses – a legal service responsible, among other things, for preparing the recognition of precedent cases and providing legal support for the tasks of the First President of the Supreme Court.
