What is private international law?
Private international law, also often referred to as “conflict of laws,” is a branch of law that mediates between the world’s different legal systems. It deals with cross-border relationships involving individuals: natural or legal persons.
Because of the potential involvement of different jurisdictions, private-law relationships that cross the borders of a single country generate entirely unique regulatory problems. A Polish judge must decide whether he or she can hear the case pending before him or her (a question of international jurisdiction), and then address the legal issues to the relevant legal systems. For example, the mere Polish citizenship of a child permanently residing with its mother on Swedish territory does not entitle a Polish court to rule on the regulation of the father’s contact with the child or the alimony owed to the child by the father (more likely, the competence of the court and Swedish law).
