What is law on arbitration?
Arbitration is one method of alternative (to state courts) dispute resolution. It allows for a flexible and quick ruling without having to go from instance to instance for years. The case is decided by one or more persons agreed upon by the parties (an arbitrator or arbitrators), instead of a state court. Arbitration is quick, less formal and flexible, which promotes efficient conflict resolution. It is commonly used in business cases, where parties value confidentiality, speed and the ability to choose who decides the case. The arbitrator’s decision, or arbitral award, is final and has binding force, meaning that it is enforced on a par with a state court judgment.
